Avoiding a Mandatory Driving Disqualification

A special reasons argument allows a court to avoid imposing a mandatory driving disqualification, even where the offence itself is admitted. It is not a defence. It applies after a guilty plea and operates as a legal exception to the normal penalty.


Special reasons are narrowly defined in law. The circumstances must:


  • Be directly connected to the commission of the offence
  • Not amount to a defence
  • Be something the court ought properly to take into account
  • Be proved by evidence
